Vietnam overstay fines in 2026
Short answer: Since 15 December 2025, overstay fines follow Decree 282/2025, which replaced Decree 144/2021. Fines start at VND 500,000–2,000,000 for under 16 days and go up to VND 30–40 million for a year or more. Deportation can be added depending on the case. Many websites still show the old, lower rates.

Examples
- 3 days over: under 16 days, so VND 500,000 – 2,000,000.
- 20 days over: 16 to under 30 days, so VND 5 – 10 million.
- 2 months over: 60 to under 90 days, so VND 15 – 20 million.
The exact amount within each range is decided case by case.
Overstay on visa-free entry
Visa-free days are a permitted stay like any visa. If you entered visa-free (for example 45 days on a UK or German passport) and stay longer, the same fine table applies. Want more time? Leave before day 45 and come back on an eVisa of up to 90 days.
Count your days before you fly
- Visa-free: your days count from your entry date, per Resolution 44/NQ-CP (for example 45 days for the UK, Germany, Japan or Korea).
- eVisa: you must leave by the end date printed on your eVisa.
- One day over is already an overstay.
How to avoid it
- Check your last legal day on your visa or entry stamp
- Book your flight out at least a day before it
- Staying longer? Sort it out before the end date. For your case, contact Vietnam Immigration: Hanoi 024 3826 4026, Ho Chi Minh City 028 3920 0365.
- Visa-free but want to stay longer? Get an eVisa (up to 90 days) for your next entry
Already overstayed?
Allow extra time at the airport if you have overstayed, as the case must be handled before departure. For your case, contact Vietnam Immigration: Hanoi 024 3826 4026, Ho Chi Minh City 028 3920 0365.
FAQ
Is the fine per day?
No. Under Decree 282/2025 the fine is set by bands based on how long you overstayed, not a daily rate.
Is the fine the same for visa-free and eVisa travelers?
The table applies to anyone staying past their permitted stay.
Are the old Decree 144 rates still valid?
No. They were replaced on 15 December 2025.
Can one day over really be fined?
Yes. Under 16 days falls in the first band, VND 500,000–2,000,000.
